• Many a times, disputes originate from lack of communication between the parties. For this reason alone, any dispute which is brought to us is first reviewed from the perspective of accurate communication. In the event we find that the parties have not communicated their intent accurately, the dispute resolution process is initiated via direct communication with the other side. We accordingly draft various letters and emails for our clients which attempt to resolve the matter amicably. Depending upon the client’s requirement, we may either monitor a negotiation or negotiate the resolution directly with the other side. We are happy to state that we have been able to resolve more than 30 disputes amicably in 2021 alone, using this approach.
• Such disputes range from shareholder disputes, management and employee disputes, contractor and supplier disputes and asset acquisition disputes.
• Upon the successful resolution, we draft customized settlement agreements for our clients, with innovative settlement terms. We are extremely proud and boastful of our ability to arrive at settlements through innovative terms and conditions. Settlement cannot be achieved if parties hold their ground, and we are adept at inculcating flexibility in our opponents. For this reason alone, our clients trust us with the most sensitive matters, where settlement is improbable and for this reason alone, we have succeeded in all our negotiations to date.
• In the event litigation is the only option available, Inrigo assists the empanelled law firm in collating accurate documentation, devising a suitable strategy and highlighting the merits of the case. While the local lawyers may have a better understanding of the procedures, we ensure that the case is presented to them in the most compelling, factually accurate and legally durable manner. We also provide the client with hand-holding during the case, and attend expert meetings along with the lawyer to ensure that the lawyer is provided with all necessary support during the proceedings.
• We also draft notices of disputes (for arbitration particularly), legal notices and other notices to be issued to the other side.

Having begun her career as a patent attorney, Aditi was introduced to the Indian courts and tribunals at a young age of 23. Due to this, case presentation is an extremely treasured aspect of her work. Aditi routinely attends arbitration hearings on behalf of her clients who also include other law firms in the UAE. These arbitrations are intitiated post a detailed review of the factual merits of the case and the matter is not taken up unless there is a definitive chance of success. As a matter of principle, we only take up 2 arbitration matters in a given month.  This permits a careful review of the cases and ample preparation time. The usual process to be followed in an arbitration is as follows:

• Review of all documentation related to the claim and preparation of an initial request for arbitration or a response to the request (as the case may be)
• Review of all relevant documents in relation to the dispute, devising a suitable strategy to defend and counter all claims,
• Representation before the applicable arbitration centre, including drafting and filing all submissions such as Statement of Claim, Terms of Reference (if any), Response(s) to the Respondent’s Answer, Statement of Defense and other claims, including responding to a challenge to jurisdiction (if any).
• Appointment of the Arbitration Panel, representation before the Panel and rendering oral submissions and arguments based on the written submissions
• Representation before any expert (if any) and cross-examination of any witness,
• Drafting any post hearing written submissions and submission of the same to the Panel
• All other representation until the issuance of the Final Award
• Any other incidental requirements such as providing case status updates, meeting(s) or telephonic discussion(s) with the client etc. depending upon the need.
• Filing an application for execution of the Final Award and representation before UAE Courts

The arbitration is conducted through the chosen associate local law firm.
